A negligence or military activity claim arises from damage or loss of property or personal injury or death due to activities of the Army and the Department of Defense.
A finding of negligence on the part of military members, DoD, or Army employees is required to establish liability except in limited cases where the activity is uniquely military in character (e.g., artillery ranges).
If you intend to file a claim against the Army, you should contact the Army claims office at the installation where the loss, damage or injury occurred. For off post incidents, investigative responsibility is assigned according to where the incident occurred. For example, Fort Belvoir is assigned responsibility for claims incidents in Prince William and Loudoun Counties; Fort Myer is assigned responsibility for off post incidents in Fairfax and Arlington Counties.
Claims are filed on a Standard Form 95 (Claim for Damage, Injury or Death). Please read the instructions on page 2 of the form before filling it out.
