Article 139 Losses
Article 139 losses/claims arise out of willful damage and wrongful taking of property committed by service members. An Article 139 claim is presented to the Special or General Court Martial Convening Authority of the alleged offender. An investigating officer (IO) makes recommendations whether the claim is payable. After a legal review and approval by the Convening Authority, the offender’s pay is withheld to reimburse the victim.
