AR 600-52 states: The goal of the SHARP Program is to create a culture free of sexual harassment, sexual assault, and associated retaliatory behaviors through an environment of prevention, education and training, response capability, victim assistance, reporting procedures, and appropriate accountability that enhances the safety and well-being of all persons covered. The program has two legally required, overarching responsibilities: prevention and response.

Sexual Harassment

Sexual Harassment is defined as: Unwelcomed sexual advances, requests for sexual favors, and deliberate or repeated offensive comments or gestures of a sexual nature by any member of the Armed Forces or civilian employee of the DOD.

  • Submission to such conduct is, either explicitly or implicitly, made a term or condition of a person’s job, pay, or career;
  • Submission to or rejection of such conduct by a person is used as a basis for career or employment decisions affecting that person; or
  • Such conduct has the purpose or effect of unreasonably interfering with an individual’s work performance or creates an intimidating, hostile, or offensive working environment.

Types of Complaints

Anonymous

Anonymous- a report of sexual harassment from an unknown or unidentified source received by a commanding officer or supervisor, regardless of the means of transmission. The individual reporting the information is not required to disclose any PII.

Anonymous complaints are a method for Soldiers and Family members (18 years of age and older) to have their concerns investigated and addressed without revealing the victim’s identity.

Formal

Formal- Require specific actions are subject to timelines and require documentation of the actions taken.

Victims are encouraged to file formal complaints in a timely manner from the date of the aggrieving behavior to ensure there is enough information for an investigating officer to investigate.

Sexual Assault

Sexual Assault- Intentional sexual contact characterized by the use of force, threats, intimidation, or abuse of authority or when the victim does not or cannot consent​.

  • Sexual Assault is a crime.

  •  Every reported sexual assault will be treated seriously.

  •  Commanders at all levels are required to immediately report to the special agent-in charge of the supporting USACID office all acts of sexual assault that they become aware of

Anyone in the chain of command, to include supervisors, first sergeants, and senior enlisted advisors, all individuals in a supervisory position, are required to report all acts of sexual assault of which they become aware

Consent

Consent-a freely given agreement to sexual activity by a competent person. An expression of lack of consent through words or conduct means there is no consent. Lack of verbal or physical resistance or submission resulting from the use of force, threat of force, or placing another person in fear does not constitute consent.

Reporting

Types of Reporting

Restricted Reporting

Restricted Reporting- Restricted reporting does not trigger an investigation. 

Allows Soldiers and Family members 18 years of age and older to confidentially disclose sexual assault  

Unrestricted Reporting

Unrestricted-Requires an investigation and command notification and allows a person who reports sexual assault to access healthcare treatment If an unrestricted report is elected, it may not change to restricted report.

Retaliation

Retaliation- wrongfully takes or threatens to take an adverse personnel action against any person; or wrongfully withholds or threatens to withhold a favorable personnel action with respect to any person for making or preparing to make a protected communication.

  • ·Soldiers reporting allegations of sexual assault shall do so without fear of retaliation by their peers, chain of command, other enlisted, officer, or civilian supervisors. Soldiers can access support and services without fear of retaliation.
  • Reprisal- taking or threatening to take an unfavorable personnel action, or withholding or threatening to withhold a favorable personnel action, for making, preparing to make, or being perceived as making or preparing to make a protected communication.​
  • Ostracism-excluding from social acceptance, privilege, or friendship.
  • Maltreatment- acts of cruelty or oppression.

Prevention

Prevention-focused on stopping sexual violence before it happens by engaging at different levels within the operational environment. Prevention requires a comprehensive approach. Everyone plays a part, the individual, peer group, unit and Army community levels. Prevention protects the force and supports implementation of the Army People Strategy, which describes how we acquire, develop, employ and retain talent
